Details: SUMMARY: Discussed request for hearing DETAILS: I called John in response to his request for a contested case hearing following the Programs order issued to the owners of McKee Bridge. He argued that because the Program was notified of the arsenic results of June 30 and because he received a message from Mike Obereigner, that he didnt need to report to the Program and didnt violate 333-061-0040(1)(d). He also stated that the park manager claims to have delivered public notice to all of the residents. I informed Mr. Staver that the requirement to report to the Program is for consultation to ensure that public health is being protected, and not simply so that the Program is aware of contamination. I also notified him that several residents stated that they never received the public notice, which is why the Program cited a violation of the aforementioned rules. We agreed that John had completed the requirement for immediate public notice and that he has already started sampling monthly. That leaves the primary unresolved compliance action in the order as having a properly functioning treatment system by the end of 2011. He stated they will do everything they can to meet this goal. We concluded the conversation on the understanding that there was no need to a contested case hearing and Mr. Staver withdrew his request a hearing. He stated that he would take the necessary action to resolve the arsenic contamination in the water system, and I stated that we would work with the water system however we could. John stated that he was unable to find many options for treatment systems or installers in Southern Oregon. I faxed Mr. Staver a list of enhineering firms and presenters from a recent conference related to arsenic remediation so that he might be able to obtain some alternative ideas and bids for arsenic treatment.
