Details: SUMMARY: Provisions at intake to restrict swimming DETAILS: I received a complaint via phone regarding a young man who dove off a bridge upstream of the City of Powers intake and drowned. The complainant believes the city, and possibly the state, are responsible because there are no "no swimming" signs posted and he believes the victim was traped by the suction of the intake. We discussed the intake construction standard OAR 333-061-0050(3)(d), which essentially states direct intake structures will be constructed with provision to restrict swimming and boating within the vicinity of the intake. The complainant claims the bridge is 65 from the intake. Our GIS maps show the bridge is ~600 upstream of the intake. I called Paul Strader with the City of Powers to report the complaint. Paul heard of the incident on the radio and went straight to the plant to assure it was shut down. Paul said the plant was shut down a few hours before the incident. He made sure to turn the intake air blowers off to assure they didnt impede the recovery efforts. No water was produced at the time of the incident nor until after the body was recovered. Paul said the intake is a couple hundred yards upstream of the intake and that the body was recovered directly below the bridge (not at the intake). I told Paul about the OAR requirement mentioned above. He said there is a no swimming sign posted on the other side of the river, but no sign near the intake. They have had trouble with people on the beach near the intake leaving garbage, etc. He was not aware of the requirement. ACTION NEEDED: I emailed both the complainant and Paul Strader the appropriate rule citation. I asked Paul to take the issue to the City Council to determine how they plan to comply. Paul will report back to Jay MacPherson regarding the Citys decision. Future action, if necessary, will be based on the Citys decision.
