Details: I sent the following e-mail to the operator on 11/28/22

I'm checking in because the water system received violations for not testing the bacteria on two consecutive quarters this year. Also a nitrate test is due before the end of December.
You should be testing nitrate in the month of the highest concentration which is June.
I have attached the new Oregon Very Small System rules.
If the water system goes eight consecutive quarters with coliform test that are negative the system can be tested once per year. Garland isn’t quite there yet.
Nitrate will have to continue to be tested annually.

The operator tested the system. The nitrate as expected continues to be above 50% of the MCL.
I emailed the operator to verify that they had received the recent test results. They responded that they had seen the results.

I responded with the following:
Because the results are consistently above 50 % of the MCL (you are above 5 ppm but not over the max of 10 ppm) you are required to test annually.
Testing in 2023 should be done at the time with the highest reading which is June.
The operator confirmed they understood.
