Details: | On 12/7/2023, Jay Williamson contact me regarding a landowner who had tapped into Jay's water line without permission and was not allowing access to the water line or the source. He was concerned about the ability to maintain the waterline (located within an easement on the landowner's property) and make needed repairs (he said the landowner had a restraining order against him which restricted his access to the waterline and several dogs that made access dangerous). He was also concerned about the potential contamination of the water line when the line was tapped into and lack of control of their usage (the water line serves multiple homes in the area). Jay said that he had spoken with Nikki Hendricks with the Oregon Water Resources Department and he said Nikki told him that the landowner did not have water rights to use water from that source (a surface water source). I mentioned to Jay that he should contact local law enforcement and that it could be a criminal if not civil matter. He asked me to see if there were laws protecting water systems from such actions so I said I would see what I could find out and recommend he work with his attorney. I followed up our phone conversation with an e-mail with some legal citations, a few examples of incidents involving tampering with water systems or stealing water. In my e-mail, I let Jay that I had spoken to Jaime Craig with Tillamook County (via phone call on 12/7/23) and would let my manager know and asked him to keep me informed of any further developments.
