| Details: | The operator recently asked how this PWS could not be qualified as a PWS. I reminded both operators that the only way this system would not be considered a PWS is if the facility could demonstrate that the facility did not meet the definitions of a 'PWS' and that water was not used for public 'Human Consumption'. Additionally they would need to demonstrate that these definitions would not be met for the current facility in perpetuity. I emailed this and other information on the nature of their accrued violations which have labelled this PWS as a Priority-Non-Complier (PNC). -Public Water System (PWS) -PWS Definition: “a system for the provision to the public of piped water for human consumption, if such system has more than three service connections, or supplies water to a public or commercial establishment that operates a total of at least 60 days per year, and that is used by 10 or more individuals per day. Public water system also means a system for the provision to the public of water through constructed conveyances other than pipes to at least 15 service connections or regularly serves at least 25 individuals daily at least 60 days of the year. A public water system is either a "Community Water System," a "Transient Non-Community Water System," a "NTNC Water System" or an "Oregon Very Small Water System."” OAR 333-061-0020(109) -Human Consumption definition “water used for drinking, personal hygiene bathing, showering, cooking, dishwashing, and maintaining oral hygiene.” The property/business owner of the prospective public water system would need to demonstrate that these definitions are not being met and will never be met for the life of the operations on the property.
