| Details: | SUMMARY: Discussed civil penalty settlement DETAILS: I called Mike to discuss his request for a hearing regarding the $1,000 penalty assessed and his January 14 request for a hearing. I identified that we can proceed to a hearing, or that we can settle the matter of the penalty with an agreement. I stated that our agreements always include a 10% up-front payment of the assessed penalty and a waiver of any further rights to a hearing or judicial review. In this case the up-front payment would also include the $250 penalty assessed for lack of lead and copper samples in 2010. Mike stated he would prefer a settlement over proceeding to a hearing. ACTION NEEDED: I will draft settlement language and send it to Mike through Gina at Nugget Management. Mike will review the settlement terms, which will be accepted or revised before signing by both parties. | ||
