Details: | SUMMARY: Discussed compliance with the arsenic MCL DETAILS: I called Laura to get an update regarding installing of an arsenic treatment system at Belle Passi Estates. I also wanted to inform Laura that the Drinking Water Program is issuing an administrative order due to the lack of compliance with our previous enforcement actions. I stated will will do our best to create reasonable deadlines based upon when funds will be available through the SDWRLF program, but that if something happens where a deadline will be missed, we need to be notified and agree to an extension. I stated that if deadlines in the new administrative order are missed without a prior extension to the deadlines our intent is to assess civil penalties. Laura did confirm that she is working with OBDD to obtain funding through the SDWRLF program. I also stated that the public notice regarding arsenic levels at Belle Passi Estates needs to be updated every three months, and that the Drinking Water Program needs to receive a copy of the notice when it is re-published. I made it as clear as possible that if we do not receive a copy of a revised public notice every three months, that it will be a violation of the forthcoming Order and could lead to civil penalties being assessed. Lastly, I informed Laura that the plan review process for the treatment system to be installed at Belle Passi is not progressing, and that we need additional information from her along with a plan review fee before it can proceed. I did add that we will allow time for possible revisions to the proposed treatment system after OBDD releases funds for the project. ACTION NEEDED: The Drinking Water Program will issue a new administrative order in the near future and we will await installation of a treatment system. |
