| Details: | SUMMARY: Discussed request for hearing regarding civil penalty proposed on 3/10/2011 DETAILS: I received an email earlier today from Tony Jurado providing an update on the process of funding installation of a treatment system at Valley Vista Estates. I responded with an email reminding Mr. Jurado and Dee Criswell that there is less than one week remaining before the psoposed penalty becomes final by default. Dee Criswell responded with a telephone call seeking information on how to request a hearing, and hearing specifics. I clarified that the hearing request can be very simple, or can include as much information as Valley Vista feels is appropriate. I also clarified that it appears that progress is being made towards the installation of a treatment system, and in light of that progess, the Program is willing to settle the matter of the penalty for 10% of the assessed amount so long as Valley Vista completes corrective action in a reasonable amount of time. ACTION NEEDED: Await request for hearing before proceeding with drafting a settlement. | ||
