| Details: | SUMMARY: Water System Deactivation DETAILS: On 1/11/13 I spoke to Hank Bynaker, the Port CEO, who questioned under what criteria they are considered to be a regulated water system under OAR 333-061. I explained the critiera and sent copies of the OAR when they were made a water system, subsequent changes to the rules regarding submetering, and the federal register notice regarding submetering and said that I would re-evaluate the applicability of the submetering criteria. Upon internal review of the rules and based upon the system purchasing water and passing only the purchase costs along to submetered connections without any markup and based upon the system having no storage or treatment facilities, the determination was made that OAR 333-061 does not apply to the Port of Astoria. ACTION NEEDED: A letter was drafted outlining the findings and the system was deactivated as a regulated water system. No further action needed. | ||
