Details: | SUMMARY: Corrective Action Plan DETAILS: I will discuss these issues with my colleagues and get back to you as soon as I can..."On 5/14/15 we responded again to the 5/4/15 communication from Mr. Fortune with a definitive determination regarding their proposed corrective action plan/schedule via e-mail. We did not approve their proposed corrective action plan/schedule. We wrote:"Mr. Fortune,I am sorry for the delay in responding to your email below-- I wanted to make sure that I replied with the most accurate information possible. To summarize your last communication, we understand that:• It is your intention to cease to be a ‘public water system’ as defined under Oregon Statute: ORS: 448.119 by reducing the population (evicting RV tenants)--o Half of the tenants are ordered to leave by 5/31/15-- ando The other half of the tenants will be ordered to leave by 7/31/15.Unfortunately, only reducing the population by evicting tenants will not fully exempt your public water system from regulation (under ORS 448.119 to 448.285, 454.235 and 454.255) because your water system will continue to serve more than 3 service connections (as defined in rule, OAR: 333-061-0020(171)) and will likely serve more than 9 people even after the RV population has vacated. Water system population (10 or more individuals per day for at least 60 days out of the year) includes regular visitors (such as employees/workers) on your connected properties, transient retail customers and any remaining residents as defined by rule.
