| Details: | SUMMARY: Discussed civil penalty Order DETAILS: Bobbie Bolden called after receiving the Notice of Intent to Assess Civil Penalties issued on February 24, 2010. She was concerned that the penalty was unwarranted due to regulatory changes over the course of several years at the water system. She was worried that requirements were changing when regulatory staff changed. She inqured about the differences in requirements between groundwater and surface water systems. She stated that the water produced by her water system was clean, and that the system passed all their tests. She also stated that requirement to maintain a DRC operator is too difficult because no operators will contract into the position, and that Jerry Bolden is too sick to take the test in Roseburg. She added that most of the residents served by the system are elderly and on fixed incomes. I explained that some regulations have been added over the last 10 years, but clarified that our construction standards apply to all community surface water systems equally. I stated that construction standards are not expected to be repealed in the future. ACTION NEEDED: Bobbie said she will be requesting a hearing and is consulting with an engineer to determine the cost of the repairs. I explained the process for requesting a hearing and coming to a settlement agreement, and also for the penalty process if the water system takes no action regarding the penalty assessment notice. | ||
