| Details: | SUMMARY: Discussed recently assessed civil penalty DETAILS: Jan called to ask about the recent administrative orders that proposed civil penalties against both the Echo Mountain and Riverbend Park water systems. I made sure Jan knew that she needs to request a hearing if she wants any chance of arguing against or settling the penalties. I clarified that each system was penalized for lack of sampling for coliform, nitrate, lead and copper, SOCs, and VOCs. I stated that if she requests a hearing we would be willing to negotiate a settlement, and would allow until later this year to bring all of the sampling into compliance. I stated that nitrate and coliform would likely need to be collected immediately, but we would consider allowing more time for collecting the organic chemicals. I also informer her that our settlement would likely require a 10% payment of the penalty immediately, all of the samples to be collected over the course of this year, and would also require that she waive her rights to a hearing. I made sure Jan was aware that she has the option to proceed to the hearing if she wished to argue that the samples were collected, or that the penalties were unwarranted for any reason, and Jan stated she did not wish to have a hearing. She just re-iterated the fact that she wants to collect the samples and settle for a reduced penalty amount. ACTION NEEDED: Await submission of a request for hearing and draft a settlement once one is received. | ||
