Details: I was able to have a discussion with the owner of this facility to discuss the violations that are accumulating at this system including missed coliform and nitrate tests and the increase in routine sampling from quarterly to monthly.

The owner confirmed that THIS FACILITY HAS NOT YET MET THE POPULATION OR CONNECTION MINIMUMS TO QUALIFY AS A PUBLIC WATER SYSTEM. Since they do not meet the definition of population served or connections they should not be an active TNC.

The system is being moved to inactive.
Testing schedules are being removed.
Violations for missed tests are being removed.

The firm plans to open an ice cream parlor with espresso service. This additional use WILL trigger drinking water rules and the facility will qualify as a Transient Non-Community water system. At such time, quarterly routine tests and annual nitrate tests will be required.

Prior to engaging in this activity, the system must complete the drinking water plan review process. This process was first presented to the firm in July of 2022 with reminders in the interim.
